UST System Inspectors have the authority to immediately shut down any part of UST system using the department-issued red- tag procedure under the following conditions:

1.           Immediate Threat: The UST system or any components of the system have been determined to pose an immediate threat or danger to life, safety or health of people.   This would include any visual evidence of leakage of a regulated substance, immediate human exposure to a regulated substance, or defective equipment resulting in the release of a regulated substance, which can include, but not be limited to overfill prevention equipment that is not functioning properly, or inadequate tank venting

2.           Material Containment Violation: UST systems that do not have leak detection, corrosion protection, or spill containment and overfill prevention installed as a requirement of Comm 10 code
